These Terms of Service (“Terms”) govern your use of teKnoculture’s managed social media service and the sm_post web application (“Service”). By creating an account or using the Service, you agree to these Terms.

1. The Service
teKnoculture provides AI-assisted social media content generation, scheduling, and publishing services. We act as an operator posting on your behalf on platforms you authorize. The quality and performance of generated content depends on the information you provide and the capabilities of underlying AI providers.

2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account. You may not share your account with others or use the Service for any unlawful purpose.

3. Acceptable Use
You agree not to:
– Use the Service to generate or publish content that is illegal, defamatory, harassing, or violates third-party rights
– Attempt to circumvent usage limits, billing, or access controls
– Reverse engineer, copy, or resell any part of the Service
– Use the Service to spam, manipulate, or deceive social media platforms in violation of their terms
You are responsible for ensuring that content published to your social media accounts complies with each platform’s policies.

4. Billing and Payment
Paid plans are billed in advance on a monthly or annual basis via Stripe. All fees are non-refundable except as required by law or at our sole discretion. We reserve the right to change pricing with 30 days’ notice. Failure to pay may result in suspension or termination of your account.
Usage-based fees (content generation costs) are billed based on actual usage at rates disclosed in the app.

5. SMS Communications
If you opt in to receive SMS messages from teKnoculture, you consent to receive text messages at the number you provide. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP. For help, reply HELP or email us at [email protected].

6. Intellectual Property
Content you create using the Service belongs to you. teKnoculture retains ownership of the platform, its code, designs, and underlying systems. You grant teKnoculture a limited license to process and transmit your content solely to provide the Service.

7. Third-Party Platforms
The Service connects to third-party social media platforms (Facebook, Instagram, LinkedIn, etc.) on your behalf. We are not responsible for changes to those platforms’ APIs, policies, or availability. Access to any platform may be interrupted or revoked by that platform at any time.

8. Disclaimer of Warranties
The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated content will achieve any particular result on social media.

9. Limitation of Liability
To the maximum extent permitted by law, teKnoculture shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.

10. Termination
Either party may terminate the relationship at any time. Upon termination, your access to the Service ends and we may delete your data after a reasonable retention period. Provisions that by their nature should survive termination (billing obligations, IP ownership, limitation of liability) will remain in effect.

11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice in the app. Continued use of the Service after changes take effect constitutes your acceptance.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
